Mihaela Tăbârcă: “We are capable of being peacemakers”

At the launch event of the Romanian Court of Arbitration for Sport, prof. univ. dr. Mihaela Tăbârcă, took the floor. She asserted that the professional and personal contribution of each arbitrator would bring a good reputation to the Romanian Court of Arbitration for Sport.

As a rule, at the end of the reasoning in judicial decisions explaining the reasons for adopting a decision, the following formula is used: “considering the above mentioned or the above retained,” followed by the solution. I cannot abandon this formula at this moment, so I will say that, considering the points presented by my colleagues, in whose motivations and presentations I fully find myself, I will just say that the professional and personal contribution each of us brings will certainly bring a good reputation to our Romanian Court of Arbitration for Sport. And this is because we are capable of being peacemakers following the exhortation “Do unto others as you would have them do unto you.” And so, let us pronounce the decisions, the solutions, in a very short time from the date of filing the arbitration requests. We can do this with balance, with full awareness of the power we have, analyzing the interests, deciding on the interests of any nature of the parties. With the habit of not relying on memory, but of reading every time the texts relevant to the case, seeing how they are interpreted in doctrine and in relevant jurisprudence. We are peacemakers and we are capable of being peacemakers because our goal is not just to resolve the conflict between two parties, usually two parties, but primarily to put an end to the conflict between two parties. Through the solutions we pronounce and, especially, through the explanation, through the motivation of those solutions, we should convince all parties, perhaps especially the one that did not win, that that solution was the one that could and had to be pronounced in the case. Considering the above mentioned, I wish our Romanian Court of Arbitration a successful journey in life. Thank you!
